    This Privacy Policy describes how LogoUp.com LLC (“LogoUp,” “us,” “company,” “our,” or “we”) collects, uses, stores, and discloses (collectively referred to as “processing”) your personal information when you visit, make a purchase, or otherwise use LogoUp.com (the “Site”).

    Use of the Site, placing an order, or other interactions with us constitutes acceptance of this Privacy Policy. Further, this Privacy Policy is incorporated into our Terms.     • Examples of purposes of collection: to provide products or services to you, to fulfill our contract with you, to process your payment information, to arrange for shipping, to provide you with order confirmation, to communicate with you, to screen orders for potential risk or fraud, to honor the preferences you have shared with us, and to provide you with information or advertising relating to our products and services.

    • Disclosure for a business purpose: may be disclosed to our service providers and vendors, such as those providing analytics, email marketing, advertising, payment processing, website infrastructure, product and design providers, order processing services, and shipping services. In addition, in certain instances, such as via our “custom store” feature, we may share your personal information submitted with the third party who created the “custom store.”

    Other Personal Information We May Collect

    In order to process orders and enhance our ability to provide relevant marketing, offers, and services to you and update our records, we may obtain information about you from other sources, such as your employer, public databases, joint marketing partners, affiliate programs, data providers, and from other third parties. This information may include your name, mailing addresses, email addresses, phone numbers, intent data (or user behavior data), IP addresses, social media profiles, social media URLs, and custom profiles for purposes of targeted advertising.

    SENSITIVE PERSONAL INFORMATION

    We do not process “sensitive personal information” (as it is defined under relevant privacy laws) in a manner that would necessitate opt-out compliance.

    MINORS

    The Site is not intended for individuals under the age of 18. If you are the parent or guardian and believe your child has provided us with personal information, please contact us via the information at the end of this Privacy Policy to request deletion.

    DISCLOSURE OF PERSONAL INFORMATION

    “SHARING” PERSONAL INFORMATION

    We may “share” (as it is regulatorily defined under various privacy and data protection laws) personal information for advertising and analytics that may include online identifiers such as IP addresses and device identifiers, among other personal information. Sharing these identifiers allows us to analyze and advertise to you via platforms such as Facebook and Google. These platforms may also use this data to provide advertising and related services to others. Sharing this information with these platforms may be considered a “sale” or “sharing” of personal information under certain laws, but we do not receive money in return.     TEXT MESSAGING

    We may use a text messaging platform to communicate with you, and by opting into such communications, you agree to these terms and conditions. Specifically, if you enter your phone number at checkout and initialize a purchase or subscribe via our text messaging subscription form or a keyword, you agree that we may send you transactional text notifications as well as marketing offers via text if consent is provided. You acknowledge that you understand consenting to receive marketing messages via text is not a condition for any purchase.

    Your phone number, name, and purchase information, among other personal information, may be disclosed to our text messaging service provider. This data will be used to send you marketing messages and transactional notifications.

    If you wish to unsubscribe from receiving text marketing messages and notifications, reply with STOP to any mobile message sent from us or use the unsubscribe link we provided you within any of our messages. You understand and agree that alternative methods of opting out, such as using alternative words or requests, may not be recognized as a means of opting out.

    EMAIL MARKETING

    Certain communications, such as marketing emails, can be terminated by accessing the unsubscribe link at the bottom of the email.

    SCREEN RECORDING

    We reserve the right to view, monitor, and record activity on the Site without further permission from you to the fullest extent permitted by applicable law. We may disclose information obtained by such viewing, monitoring, or recording to our service providers and law enforcement, including in connection with improving the Site and in the investigation or prosecution of possible improper or criminal activity involving the use of the Site.

    DATA RETENTION

    We will retain your personal information for as long as necessary or as permitted for the purposes set out in this Privacy Policy.     • Temporary denylist of credit cards associated with certain fraud indicators.

    Minors

    We do not knowingly “sell” or “share” (as those terms are defined by the CCPA as amended by the CPRA) the personal information of those under 16 years old.

    • Deletion: The right to request deletion of personal information we collect or maintain;
    • Opt-Out: The right to opt out of any sale, certain sharing, and certain types of processing of personal information (for example, certain types of automated decisionmaking, profiling, and certain types of processing of sensitive personal information); and
    • Non-Discrimination: The right to non-discriminatory treatment for exercising your rights under California law.

    We do not sell your personal information as per the definition of "sale" under Nevada's Revised Statutes Chapter 603A

    DATA TRANSFERS

    We are based in the United States, and if you are accessing our Site or placing an order from outside the United States, please be aware that your personal information may be transferred, stored, and otherwise processed by us (and by third parties with whom we may disclose your personal information) in the United States and in other countries where privacy protections may be lesser than those of where you reside. However, we will take measures to protect your personal information in accordance with this Privacy Policy and applicable law.

    DO NOT TRACK & UNIVERSAL OPT-OUT MECHANISMS

    At the time this Privacy Policy was last updated, no uniform technology standard for recognizing and implementing “Do Not Track” (DNT) signals and related “Universal Opt-Out Mechanisms” has been finalized. As such, at the time of this writing, we do not respond to DNT browser signals or similar mechanisms that automatically communicate your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will update our practices accordingly.

    COMPLAINTS

    If you are not satisfied with our response to your complaint, you may have the right to lodge your complaint with the relevant data protection authority.

    SECURING PERSONAL INFORMATION

    We implement reasonable safeguards in line with our business sector to protect personal information.

    SEVERABILITY

    Any part, provision, or representation of this Privacy Policy that is prohibited or which is held to be void or unenforceable shall be ineffective to the extent of such prohibition or unenforceability without invalidating the remaining provisions hereof.

    UPDATES

    We may update this Privacy Policy from time to time to reflect changes to our practices or for other operational, legal, or regulatory reasons. Continued use of the Site and other interactions with us after updates are made to the Privacy Policy will be governed by the updated Privacy Policy.
